Henderson County dairy farmer faces felony charge for polluting nearby stream

Michael Richa rd Corn, 64, of Fletcher was arrested Oct. 31 and charged with a felony Clean Water Act violation after liquid animal waste from his Small Acres Dairy Farm polluted an unnamed tributary of the French Broad River, according to court records.

An arrest warrant states that Corn told employees at his Mills River farm to drape a PVC pipe over the rim of a waste retention pond so it would divert the flow of liquid waste into the stream.

Corn also was charged with failing to renew a permit associated with animal waste management that expired on Oct. 1, 2009, according to Landon Davidson, regional aquifer protection section supervisor of the N.C. Division of Water Quality, a division of the state Department of Environment and Natural Resources.

The permit allowed liquid and solid wastes from the 250head dairy operation on Jeffress Road to be dispersed on 4.6 acres of Corn's land.

Corn has been cited three times since September 2004 for willfully discharging waste into the stream, Davidson said.
