Bonds raised, felonies added for vandalism suspects

This afternoon, a judge raised the bonds of 11 suspects arrested in the May 1 vandalism spree in downtown Asheville. The 11 also face felony charges of incitement to riot, felony conspiracy and injury to building, fence or wall.

At the request of Assistant District Attorney Justin Steen, Judge Dennis Redwing raised the bonds for 10 of the 11 suspects from $10,000 to $50,000. Steen said the rise is justified because of “the gravity of the charges” and the fact that all but two of the suspects don’t live in Asheville.

The 11th suspect, Asheville resident Naomi Rachel Ullian had been released on bond earlier, but was arrested and handcuffed in front of the courtroom on the additional felony charges. She’s currently being held on a $42,000 bond. Ullian was the only one of the suspects arraigned in the courtroom. The others made their appearances by video and were polite in their interactions with Redwing.

All the suspects — except UNCA biology major Havely Carolyn Carsky, who said she would hire an attorney — asked for a public defender. Two of those arrested had affiliations with anarchist groups, and the Web site Anarchist news has posted a call for funds to help with their release. It’s still unclear if there was a particular grievance or goal behind the vandalism

The 11 will next be in court Tuesday, may 4, for arraignment on the felony charges.

    Look, you MUST remember that every single person arrested is only a suspect. The people doing this were wearing masks, there is no way of knowing whether the people arrested were even part of this group. All we know is that these kids were downtown when shit went down.

    So DON’T treat them as if they are already guilty of everything you imagine to have happened. Just because they got arrested doesn’t mean that they had anything to do with smashing any windows at all.

    I do not condone the actions that happened however I hear all of the judgments that are being passed and I can speak for one individual who does not fit into any of these categories.

    Havely Carsky is not an idiot, she is not violent or a spoiled brat. She has worked a job while attending UNC Asheville and has made the Dean’s List several times. She has a kind demeanor, she is honest and a very peaceful individual to be around.
    I can only ask, if she is this way, maybe some of the others are too or perhaps the APD has falsely charged once again??

    Honestly I have yet to hear of any evidence of these kids actually being the culprits. There was a sweep downtown and these these eleven were picked up. Have any of you read of these 11 actually being linked to the incidences besides being downtown?

    The case against them sounds shoddy actually.

    It looks like the APD isn’t going on much except a grainy video of people wearing dark cloths in masks.

    I’m just happy I wasn’t downtown in my usual dark garb that night.

    As mentioned by the anonymous poster above your personal judgments neither help your argument nor do they prove anything except your resentful of a kid who went to Goddard and has a tattoo. Also it hasn’t even been proven these kids are “anarchist”. Come on your low level internet research should have come up with at least that fact.

    Only 2 out of 11 have even been accused of being “anarchist” which also doesn’t prove there guilty. One supposedly has been part of a community group that “engaged in many local projects including counter-recruitment work, community gardens, prisoner support, legal work for dissidents and working class people, anti-racist education, and neighborhood organizing.”(Kansas Mutual Aid myspace) Scary stuff! hehe…The mere definition of mutual aid is so frighting, an equal exchange between people. Come on.

    These people rounded up deserve to be heard and as stated by the above posters I have yet to hear of any evidence against these individuals.

    Get your shit straight and take a breather. Your letting your own hangups get in the way of your critical thinking.

    Jr, I actually agree that taggers are selfish little pricks. Taking initiative to beautify a rundown wall somewhere with art doesn’t bother me, but scrawling tags on privately owned buildings is unconscionable.

    The first time that I got a threatening letter from the city, demanding that I pay to have a building that I am struggling to pay the bills for repainted, or be fined a great deal of money, made me feel victimized twice; first by the imbecilic taggers, and then by the city.

    Every time I repaint it, it is spray-painted with tags again. I’m not poor, but it is a struggle to pay the bills, and my anger towards those arrogant little bastards is pretty severe. When I can’t afford to fix a whole in my tooth, it makes me pretty fricking resentful to have to pay to clean up their crap.

Personally, I don’t even mind when a graffiti artist improves a space, it can even be a gift, but taggers are vermin.     No we don’t have to remember anything of the sort. The court must refrain from judging guilt or innocence…but the court of public opinion does not. When the miscreants were planning their little smash and dash party, they should hve done some investigating into Asheville’s ability to catch most criminals pretty quickly.
    Jesus may forgive thme for their mis-deeds…but I don’t.

    I think that it’s pretty obvious to us all that the cops caught the right group. For one thing, the police were on the spot in *minutes*…a group of folks trying to run away from the scene would’ve been fairly easy to identify.

    also, the majority of this group were from out of town and are unlikely to just have been “hanging out” at Pritchard Park at 11pm.

    Additionally, I know for a fact that several of these “activists” were trying to acquire spray paint and suchlike the day before the incident. I happen to have some of it on video, matter of fact. I am able to pretty clearly identify at least three of these “suspects” from the video in my possession plus their mug shots.

    of course, it is up to the courts to determine all of the facts – but I suspect most of these morons will plead down/guilty before it even comes to that.

    When the store did stock it, it never “sold” but somehow it was always missing from the shelf…and there was a consistently a lot of uber-crappy sprayed tags around.

    It would clearly have nothing at all to do with my pricing, since these non-customers dont’ actually “buy” the stuff- they seem to take some sort of bizarre pride in stealing it.

    Thus, no more sales of spray paint at the downtown art supply store. We’re not cool with that. the end.

A significant amount of graffiti has the permission of the property owner, some is done BY the property owner, and more has the passive tolerance of owners who don’t mind the wood protection from a bit of added paint. The primary violation of property rights comes from the NIMBYs and cities who force owners to remove graffiti. The property violation of the graffiti producers is quite secondary.
    It looks to me like the police and DA are wasting their time on nonviolent action against some luxury glass on which nobody depended, when they have antigay and antihomeless violent hate crimes to investigate

    If the property owner who agrees to have their property painted lives in a jurisdiction where they will have to remove the paint or face consequences, that is their decision.

    For those that do not want to be in that position, they have been wronged and the guilty party needs to be punished as any vandal.
