Asheville Police Department Detectives identified and charged one of the men who was in possession of a firearm during a recent demonstration in downtown Asheville.
Duncan A. Small, 30, of Florida, was charged by the Asheville Police Department with a weapons violation on Tuesday, June 28. The following day, he was arrested by Waynesville Police Department, served with his warrant and released. A second subject who was wearing body armor and may have also been carrying a firearm was identified, and that investigation is ongoing.

North Carolina General Statute 14-277.2 states: It shall be unlawful for any person participating in, affiliated with, or present as a spectator at any parade, funeral procession, picket line, or demonstration upon any private health care facility or upon any public place owned or under the control of the State or any of its political subdivisions to willfully or intentionally possess or have immediate access to any dangerous weapon. Violation of this subsection shall be a Class 1 misdemeanor.
