AC-T: Court rejects CTS appeal of Superfund cleanup

A court on Tuesday rejected a challenge to a decision by the U.S. Environmental Protection Agency to place a contaminated Superfund site in Buncombe County on the National Priorities List for cleanup, according to the Asheville Citizen-Times.

CTS Corp. last year appealed the inclusion of the Mills Gap Road site on the list, claiming that EPA succumbed to “mounting political pressure” and ignored evidence of other potential sources of toxic chemicals found in wells.

But the U.S. Court of Appeals for the District of Columbia Circuit said in its ruling that the company’s arguments amounted to “little more than methodological nitpicking.”

“Each of CTS’s objections is without merit, forfeited or impermissibly based on extra-record evidence,” the court said.
