A company proposing to operate an asphalt plant in East Flat Rock has allegedly withdrawn its rezoning request to the Henderson County Board of Commissioners, according to an email from Friends of East Flat Rock, the group opposing the permitting of the plant. The group’s email had attached to it an email saying it was from the company’s attorney, Brian Gulden, which read as follows:

In light of Commissioner Edney’s communication to the Hendersonville Times-News concerning this application and after discussing the same with other Commissioners who expressed that it would be beneficial to withdrawal the application at this time, please accept this correspondence as HS Shipman’s formal withdrawal of application #R-2021-01-C.
As you are aware, the Commissioners were to reconvene this evening to take a vote on approval of the Conditional Zoning application.
With this withdrawal, neither my client nor myself will appear at tonight’s meeting.
