Notice of Buncombe County Board of Adjustment Special Meeting

Notice is hereby given that the Buncombe County Board of Adjustment (the “Board”) will hold a meeting on Wednesday, July 14 2021 at 12:00pm (the “Meeting”), at which the Board will hold public hearings to consider the following applications:

ZPH2021-00024 Broad River Village SUP (Formerly referred to as a CUP): Scott Gillispie of Deep River South Development, on behalf of LANCE WM C; LANCE JEANNE; SHERRY LANCE BROOKSHIRE, EXECUTOR, has applied for a Special Use Permit pursuant to the Zoning Ordinance of Buncombe County, Sec. 78-641(a), Sec. 78-677, and Sec. 78- 678(b)(6), to establish a Planned Unit Development (Level 1) for a 89 residential unit townhome development on tax lot PIN 9626-53-4920 (79 Morris Rd); Planner coordinating the review: Joshua Freeman.

ZPH2021-00027 Crescent Hill SUP (Formerly referred to as a CUP): Thomas Jones of WGLA Engineering, Authorized Agent, on behalf of William Ratchford of Southwood Realty Company, Applicant, and Gregory Scott Lynch, Brennen and Sheila McElhaney, and Barbara J. Lynch, Owners, has applied for a Special Use Permit pursuant to the Zoning Ordinance of Buncombe County, Sec. 78-641(a), Sec. 78-677, and Sec. 78-678(b)(6)Sec. 78-641(a) and 678(b)(6), to establish a Planned Unit Development (Level 1) for a 252 residential unit apartment development on tax lot PINs 9653-36-3639, 9653-37-7780, 9653-37-6279, 9653-36-5719, and 9653-36-3297 (180, 184, 188, and unaddressed on Watson Road); Planner coordinating the review: Joshua Freeman.

Due to the COVID-19 pandemic, this Meeting will be in-person for Board Members only. No Board members will be participating in the Meeting remotely. Members of the public and applicants may participate in, watch, and/or listen to the Meeting via ZOOM free of charge at the following online location. The public may also listen to and/or participate in the Meeting via telephone by calling: (646) 558-8656 and entering Meeting ID: 918 6237 7366.

Applicants and parties with standing are asked to inform the Board once they have entered the Zoom meeting so that they may be made panelist when their case is called, which will allow them to present evidence, control which screens are visible to participants and viewers, and utilize other Zoom features. County Staff familiar with Zoom technology will be available to assist members of the public having difficulties participating in the Meeting.

Pursuant to N.C. Gen. Stat. § 143-318.13(a), and in addition to the online location and dial-in option referenced above, the Board is providing the following location and means whereby members of the public may listen to the Meeting: members of the public may listen to and watch a live Zoom feed of the Meeting in the meeting chambers located at 30 Valley St., Asheville, NC 28801, at no charge, on a first-come / first-serve basis. Due to the COVID-19 pandemic and N.C. Executive Order No. 176, attendance will be limited. The Board asks that this resource be utilized only by those who need it, and further encourages that those with questions, or who wish to utilize this resource, relay their interest to the Buncombe County Planning Department.

Additionally, the Board is providing means by which members of the public who are unable to participate in the Meeting due to a lack of computer, phone, and/or internet access may participate. Those members of the public may participate via Zoom at 30 Valley Street, at no charge, on a first-come / first-serve basis. Due to the COVID-19 pandemic and N.C. Executive Order No. 176, attendance will be limited. A member of County staff will be on-site to provide assistance. Those utilizing this resource may be asked to certify under penalty of perjury that they are unable to participate in the Meeting due to a lack of computer, phone, and/or internet access. Those wishing to utilize this resource are encouraged to relay their interest the Buncombe County Planning Department.

Members of the public who are unable to participate in the Meeting via Zoom due to a lack of technological literacy or other reason may request a reasonable accommodation in writing signed under penalty of perjury requesting a reasonable accommodation, outlining their need for a reasonable accommodation, and providing sufficient contact information to the Buncombe County Planning Department for further assistance no later than forty eight (48) hours prior to the Meeting.

Those wishing to provide witness testimony should, and those requesting to participate as a party with standing must, inform the Board in writing at least 24 hours prior to the hearing by writing to: Buncombe County Planning, 46 Valley St., Asheville, NC 28801, or emailing: PlanningInfo@buncombecounty.org.
